These Terms of Service (the “Terms”) govern your access to and use of the Axiom GEO service at geo.axiomai.uk (the “Service”), provided by Axiom Flux Ltd, a company registered in Scotland (“Axiom Flux”, “we”, “us”, “our”).
By creating an account, accessing or using the Service you agree to these Terms. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
Service description
Axiom GEO is a multi-tenant SaaS platform that provides:
- Generative-search visibility monitoring across AI engines (ChatGPT, Claude, Gemini, Perplexity and similar).
- SEO and rank-tracking using third-party search-data providers.
- Google Analytics, Search Console, and Google Business Profile data integration on a per-workspace basis.
- Marketing-attributed review monitoring, citation tracking, page-quality analysis and reporting.
Account registration
- You must provide accurate, current information when creating an account and keep it up to date.
- You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately of any unauthorised use.
- You must be at least 16 years old and have authority to enter into a contract.
- One person or legal entity per account, unless otherwise agreed in writing.
Subscriptions, credits and billing
- Subscription tiers — fees, included credits, and feature limits are described on our pricing page or in your order form. Subscriptions renew monthly or annually until cancelled.
- Credits — most paid actions (AI prompt runs, SERP fetches, GBP syncs, review pulls) consume credits at published rates. Included monthly credits reset at the start of each billing period and do not roll over.
- Top-up packs — additional credits purchased on top of a subscription. They do not expire while your subscription is active.
- Cancellation — you may cancel at any time from the billing portal. The Service continues to the end of the paid period; we do not refund partial periods.
- Refunds — fees are non-refundable except where required by law or expressly stated in writing.
- Price changes — material price changes are notified at least 30 days in advance. Continued use after the change date constitutes acceptance.
- Taxes — fees are exclusive of VAT and other applicable taxes, which are added at checkout.
- Failed payment — we may suspend access to the Service if a payment fails for more than 14 days.
Acceptable use
You agree not to:
- Use the Service to scrape data you do not own or have permission to access.
- Submit prompts or content that violates the AI providers' usage policies (Anthropic, OpenAI, Google, Perplexity).
- Reverse-engineer, decompile, or attempt to extract source code or proprietary algorithms.
- Share account credentials with people outside your organisation, or resell access without prior written agreement.
- Use the Service to send spam, phishing, malware, or other unlawful content.
- Attempt to interfere with the integrity, security or availability of the Service (DDoS, brute-force attacks, unauthorised penetration testing, etc.).
- Use the Service in violation of any applicable law, regulation, or third-party right.
We may suspend or terminate accounts that violate these rules, with or without notice depending on the severity.
Intellectual property
- Our IP — Axiom Flux retains all rights, title and interest in the Service, including all software, interfaces, branding, documentation, and aggregated / anonymised analytics. These Terms grant you no rights to our IP except a limited, revocable, non-exclusive licence to use the Service in accordance with these Terms.
- Your content — you retain all rights to content you upload (client domains, prompts, exports, logos, etc.). You grant us a worldwide, non-exclusive, royalty-free licence to host, process and display this content for the sole purpose of providing the Service to you.
- Feedback — if you send us suggestions, we may use them without restriction or compensation.
Third-party services
The Service integrates with third-party APIs (AI providers, Google APIs, payment processors, search-data providers). Your use of those integrations is also subject to the respective third-party terms. We are not responsible for their availability, accuracy or behaviour, but we will provide reasonable assistance if a third-party outage affects your use of the Service.
Data protection
Our handling of personal data is described in our Privacy Policy. For business customers a Data Processing Agreement (DPA) compatible with UK GDPR is available on request.
When you connect Google Analytics, Search Console, or Business Profile, we adhere strictly to the Google API Services User Data Policy (including the Limited Use requirements). See our Privacy Policy section 3 for the specific commitments.
Service availability and support
- We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance is communicated in advance where possible.
- Support is provided via email at support@axiomflux.co.uk during UK business hours. Faster response targets may apply to specific subscription tiers as set out in the order form.
- Beta or experimental features may be made available from time to time; they are provided without warranty and may be changed or removed without notice.
Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Axiom Flux disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of any AI-generated output.
AI engine outputs are inherently probabilistic and may contain errors, hallucinations, or omissions. You are responsible for reviewing and verifying any output before relying on it for business decisions.
Limitation of liability
To the maximum extent permitted by the laws of Scotland and the United Kingdom, Axiom Flux's aggregate liability arising out of or in connection with the Service is limited to the fees you paid in the 12 months preceding the event giving rise to the claim.
Neither party is liable for indirect, special, incidental, consequential, or punitive damages, including loss of profit, revenue, data, business opportunities or goodwill.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded under the laws of Scotland and the United Kingdom (including death or personal injury caused by negligence and fraudulent misrepresentation).
Indemnification
You agree to indemnify and hold Axiom Flux harmless from any third-party claims arising out of (a) your breach of these Terms, (b) your content or use of the Service in violation of any law, or (c) your infringement of third-party intellectual-property rights.
Term and termination
- These Terms remain in effect while you have an account.
- You may terminate at any time by deleting your account; we may terminate for material breach (with notice and a cure period of 14 days where reasonable) or for non-payment.
- On termination we delete your account data per the retention schedule in our Privacy Policy. Sections that by their nature should survive termination (IP, liability, indemnity, governing law) continue to apply.
Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. Material changes are notified at least 30 days in advance via email or in-product notice. Your continued use after the effective date constitutes acceptance.
Governing law and disputes
These Terms are governed by the laws of Scotland. The Scottish courts (the Court of Session and the sheriff courts) have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except that we may seek injunctive relief in any jurisdiction where infringement of our intellectual property occurs.
General
- Severability — if any provision is held unenforceable, the rest continues in effect.
- No waiver — failure to enforce a right is not a waiver of that right.
- Assignment — you may not assign these Terms without our prior written consent. We may assign in connection with a merger, acquisition, or sale of assets.
- Entire agreement — these Terms and the Privacy Policy form the entire agreement between you and Axiom Flux regarding the Service.
- Notices — notices to you may be sent by email or in-product. Notices to us must be sent to legal@axiomflux.co.uk.
